1. Payment Terms
Subscribers of Home Exam may choose between monthly or annual payment options.
- Monthly Subscription:Monthly payments are processed automatically via recurring credit card billing. Failure to make a scheduled payment will result in immediate cancellation of the subscription.
- Annual Obligation:If a subscriber receives their annual home inspection prior to completing all twelve (12) monthly payments and subsequently:
- Requests cancellation, or
- Has a past due payment
then the subscriber is required to pay the remaining balance of the annual subscription in full before the cancellation will be processed.
2. Limitations of Liability
Home Exam provides home inspection services on a best-effort basis.
- Home Exam shall not be held liable for any damages that occur during or as a result of a home inspection.
- Home Exam is not responsible for errors, omissions, or damages caused by third parties, including but not limited to contractors, service providers, or other professionals.
- All inspections are visual and non-invasive unless otherwise specified, and no guarantees or warranties are expressed or implied.
3. Intellectual Property
All materials created, distributed, or displayed by Home Exam are the exclusive property of Home Exam.
- This includes, but is not limited to, logos, branding, reports, documents, and marketing materials.
- All such materials are protected under applicable trademark and intellectual property laws.
- Unauthorized use, reproduction, or distribution of Home Exam’s intellectual property is strictly prohibited.
4. Termination
- Notice Requirement:All subscription termination requests must be submitted in writing via email directly to Home Exam.
- Before Annual Inspection:If a subscriber cancels their subscription prior to receiving their annual home inspection within the calendar year, they are entitled to a full refund of all payments made, minus any credit card processing fees incurred by Home Exam.
- After Annual Inspection (Monthly Subscribers):If a subscriber cancels after their annual inspection has been completed and is on a monthly payment plan, the remaining balance of the annual subscription is due in full before cancellation will be approved.
5. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Michigan, without regard to its conflict of law principles.
